Under the moderation of Stratis Georgilas, Dr. Torres Camprubí, Stephen Fietta KC and Lesther Ortega were invited to participate in the panel on “Moving Dispute Settlement Forward”.
The panelists shared their perspectives on the current state of international dispute settlement, with a particular focus on international arbitration and Inter-State Litigation.
Key topics addressed included the role of bona fide negotiations in dispute resolution and the increasing use of interventions (both under Articles 62 and 63 of the ICJ Statute) reflecting community interests in bilateral cases; the fate of Article 36 Optional Clause and the advisory jurisdiction of international courts and tribunals. The panelists also reflected on the evolution of the International Court of Justice’s docket over the past 25 years. The audience’s questions and comments covered areas such as the role of non-state actors and the innovative procedural measures courts and tribunals are adopting to manage growing workloads and challenges such as the COVID-19 pandemic.
